Usted señala un excelente punto y es que el Artículo 184 no dice expresamente que el Consejo de Estado tiene potestad exclusiva para decretar pérdida de investidura. Si el artículo dijera eso, está claro que el Procurador no se hubiera atrevido a destituir a Piedad. Es en esa ambigüedad en la que reside el poder que de facto ha ejercido el Procurador en ya dos ocasiones, y quizás lo haga en otras más.

Sin embargo, existe la posibilidad de que el Consejo de Estado y sus magistrados interpreten el poder que les otorga el Artículo 184 como su facultad exclusiva, y quieran cuidar celosamente ese poder en vez de compartirlo con la Procuraduría. Así como es válido el argumento que usted hace, también es válido el argumento que los constituyentes que redactaron el Artículo pudieron haber incluido a la Procuraduría explicitamente en el texto, pero no lo hicieron. Como se le da importancia a las palabras escritas en la Constitución, podría decirse que quien sugiere una interpretación que va más allá de la escrita tiene la carga de probar que esa interpretación es constitucional. Así pues, habría una presunción que es el Consejo de Estado quien tiene facultad para decretar pérdida de investidura, y cualquier otro organismo que quiera clamar para sí ese poder (en este caso la Procuraduría) debe demostrar afirmativamente que lo tiene.

El punto es que no se sabe. El Consejo de Estado podría fallar en cualquier sentido. No sé si la Corte Constitucional se haya pronunciado al respecto. Quizás.

Yo no veo la incompatibilidad,al menos lógicamente. El artículo 184 que menciona la defensa de piedad no dice que la pertida de investidura solo será decretada por el Consejo de Estado. Me parece que es una conjunción (pueden hacerlo el Consejo de Estado o el Procurador).

Ok, i agree that our minimum wage is way too high and increase it more would bring out more unemployment.

But, let´s try to make some other proposals. If we reduce the "parafiscales" and some contributions to health system; we could have, anyway, a reduction in the wage that the entrepeneurs pay to the workers; so they could hire more people and increase the employment.

You may argue that our health system could'nt survive with a reduction in there rents. But, if there´re more people in the system; they will have more rents to compensate the lost of contributions. Of course, we need some econometrics to see if this would work.

By the way, i don´t like neither the fact that government, unions and bussines make meetings to define the minimum wage; that´s way too much political economy. But, i´m not saying that market should define minimum wages, Keynes prooved that this doesn´t work neither; this should be measured by technical experts, insted of politicals negotations

I knew that some readers would disagree with the classification I present here. Mr. Rojas' arguments is valid to the extent that sometimes governments inherit negative or positive balances in their accounts from previous administrations, which is why the graph could be taken with some skepticism.

Nonetheless, Mr. Rojas' argument that Spain's current fiscal deficit is somehow affected by the "cultural baggage" of Franquismo, 35 years after Franco's death is farfetched, to say the least. I believe most people would agree that Spain's 2010 fiscal deficit has more to do with the government that has managed expenditure for the last six years than with the old dictator.

For Germany, the case is the same. Perhaps past left-wing German governments were thrifty, and I tend to think that generally the Germans are usually very responsible with their fiscal accounts. However, you cannot take the 5 years of Merkel's government entirely out of the picture and say that she is fiscally responsible today simply because she inherited that policy approach from another government half a decade ago.

I think the case of greece is quite particular. The real data never appeared until the leftist government, elected last year, showed the real depth of the crisis generated by the old right government.
In a similar way, the fiscal policy which is effective nowadays in Germany was generated while the left government was in the power (in fact, the Harz IV which made Germany competitive again was what cause the fall out of the left government). However, now the right wing coalition (at least the junior partners of the new government) want to increase the debt by reducing taxes while keeping a lot of expenditure.
All in all, I think this "apriori" analysis requires something more. You cannot just label the government as left or right without consider the recent changes in government. In some cases, like in Spain, despite having a leftist government, the country continue fighting with the cultural baggage left by Franco more than forty years ago.
